Terms of Service

Effective: July 17, 2026 · These terms govern the Ella Founding Family Pilot and use of ella-ai-care.com.

1. The service

Ella is a personal AI companion for independent living, currently offered as a limited private pilot in Palo Alto, California. Ella provides conversational companionship, contextual reminders and cues, personal memory, and privacy-filtered family summaries and alerts. Capabilities may change during the pilot; we'll communicate changes directly.

2. The pilot offer

The Founding Family Pilot includes the Ella hardware kit (companion pendant and open-ear headset), personalized setup, and the service — free for the first three months, then $49/month. Cancel anytime; billing stops at the end of the current cycle. The hardware kit is yours to keep, including if you cancel. Pilot participation may be limited by geography and capacity.

3. Not a medical device — read this

Ella is a personal companion and reminder tool, not a medical device. Ella does not diagnose, treat, prevent, or monitor any medical condition, does not guarantee detection of emergencies, and is not a substitute for professional medical care, supervision, or emergency services. Never rely on Ella as a safety system. In an emergency, call 911.

4. Consent and appropriate use

The primary user must personally consent to using Ella during onboarding. The family agrees to inform household members and regular visitors that Ella may process conversations in the home, as described in our Privacy Policy. You agree not to use Ella to record people without their knowledge, to harass, or to break the law.

5. Your content and data

Your family's data is handled as described in the Privacy Policy, which is part of these terms. You grant us the limited license needed to operate the service (process audio into memory, generate summaries, deliver messages). We do not sell personal data.

6. Service quality

The pilot is an early product offered "as is." We work hard to make Ella reliable, but we do not warrant uninterrupted or error-free operation, and AI systems can make mistakes — Ella may occasionally mishear, misremember, or miss a moment. That is precisely why Section 3 matters.

7. Liability

To the maximum extent permitted by law, Ella AI Care's total liability for any claim arising from the service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited under California law.

8. Ending the pilot

You can cancel anytime by emailing hello@ella-ai-care.com. We may suspend or end pilot participation for misuse or if we wind down the pilot; if we do, we'll refund any prepaid unused period and honor data-deletion requests.

9. Governing law

These terms are governed by California law. Disputes will be resolved in the state or federal courts of Santa Clara County, California.
